1. Definitions

1.1 Service Terms

  • Service: The IQTest360 platform, including all features, assessments, training programs, and content
  • Subscription: Your paid access plan to IQTest360 premium features
  • Content: All text, images, data, assessments, reports, and other materials provided through the Service
  • User Data: Information you provide or generate while using the Service

1.2 Party References

  • "We," "Us," "Our": IQTest360 and its operators
  • "You," "Your": The individual user of the Service
  • "Parties": Both you and IQTest360, collectively

2. Welcome to IQTest360

Welcome to IQTest360, a comprehensive cognitive assessment and brain training platform. These Terms and Conditions ("Terms") govern your use of our services, including IQ assessments, personality tests, trivia training, puzzles, and all related features.

By accessing or using IQTest360, you agree to be bound by these Terms. If you do not agree, please do not use the Service. We encourage you to read these Terms carefully before making any purchase or subscribing to our services.

3. IQ Testing Disclaimers

3.1 Nature of Assessment

IQTest360 provides cognitive assessments for educational and entertainment purposes only. Our assessments are designed to provide an estimated measure of cognitive ability based on standardized question formats, but they:

  • Are not a substitute for professional psychological evaluation
  • Do not constitute a clinical diagnosis of any kind
  • Should not be used as the sole basis for academic, employment, or medical decisions
  • May vary in accuracy based on testing conditions and individual factors

3.2 Score Interpretation

IQ scores and cognitive assessments provided by IQTest360 are approximate estimates. Actual cognitive ability may differ from the scores presented. For comprehensive cognitive evaluation, we recommend consulting a licensed psychologist or qualified mental health professional.

3.3 No Medical or Professional Advice

Our personality assessments, ADHD screenings, career fit analyses, and other tests are informational tools and do not constitute medical, psychological, or professional advice. Results should be interpreted as general guidance only.

4. Acceptance of Terms

4.1 Agreement

By creating an account, subscribing to our services, or using any IQTest360 features, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms and our Privacy Policy
  • You meet the eligibility requirements described below
  • You consent to the collection and processing of data as described in our Privacy Policy

4.2 Updates to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of IQTest360 after changes constitutes acceptance of the updated Terms.

5. Account Eligibility

5.1 Age Requirement

You must be at least 18 years of age to use IQTest360. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly collect data from individuals under 18.

5.2 Account Responsibility

You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of your account information
  • Notifying us of any unauthorized use of your account

5.3 Account Restrictions

You agree not to:

  • Create multiple accounts for the same individual
  • Share your account access with others
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to circumvent any technical limitations or security measures

6. Subscription Services

6.1 Subscription Plan

IQTest360 offers the following subscription plan:

  • Monthly Plan: $29.99/month — Full access to all premium features including IQ reports, personality assessments, trivia training, puzzles, and future content

6.2 Trial Period

New users receive a 7-day trial upon initial registration. During the trial period:

  • A one-time payment of $1.00 (charged as two $0.50 transactions) is required to activate the trial
  • You receive full access to all premium features during the trial period
  • After the 7-day trial, your subscription automatically continues at $29.99/month unless canceled before the trial ends

6.3 Billing

  • Subscription fees are billed monthly on the same date each month following your trial period
  • All payments are processed securely through Stripe with support for 3D Secure authentication
  • Prices are in USD unless otherwise indicated
  • You authorize recurring charges to your payment method on file
  • Failed payments may result in temporary suspension of access until payment is resolved

6.4 Credit Purchases

In addition to the subscription, IQTest360 offers credit packages for trivia training. Credits are used as training lives and can be purchased separately:

  • 5 credits — $0.99
  • 20 credits — $3.99
  • 50 credits — $6.99

Credit purchases are one-time, non-recurring charges. Credits do not expire but are tied to your account and are non-transferable.

6.5 Cancellation

  • You may cancel your subscription at any time through the cancellation page or by contacting us at info@iqtest360.com
  • Cancellation takes effect at the end of the current billing period — you retain access until then
  • No partial refunds are provided for unused portions of a billing period
  • You may also reach our support team at our Help Center

6.6 Retention Offer

When you initiate cancellation, we may offer you a discounted rate of $6.99/month (instead of $29.99/month) to continue your subscription. If you accept:

  • The discounted rate takes effect from your next billing date
  • All premium features remain fully accessible
  • You may still cancel at any time under the same terms

7. Refund Policy

7.1 General Policy

Due to the digital nature of our services, all sales are generally final. However, we may consider refund requests on a case-by-case basis.

7.2 Refund Eligibility

You may be eligible for a refund if:

  • You were charged incorrectly or in error
  • You experienced a technical issue that prevented you from accessing the Service, and our support team was unable to resolve it
  • You request a refund within 14 days of your initial purchase and have not substantially used the Service

7.3 Non-Refundable Items

The following are not eligible for refunds:

  • Credit purchases that have been used (partially or fully)
  • Subscriptions where significant content has been accessed or consumed
  • Charges that are more than 14 days old

7.4 How to Request a Refund

To request a refund, contact our support team at info@iqtest360.com with your account email and a description of the issue. We aim to respond within 3 business days.

7.5 Chargebacks

We encourage you to contact us directly before initiating a chargeback with your payment provider. Chargebacks incur additional processing fees and may result in account suspension. We are committed to resolving billing issues promptly and fairly.

8. Intellectual Property Rights

8.1 Our Content

All content on IQTest360, including but not limited to assessments, questions, reports, training materials, graphics, logos, and software, is the intellectual property of IQTest360 and is protected by applicable copyright, trademark, and other intellectual property laws.

8.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

8.3 Restrictions

You may not:

  • Copy, reproduce, distribute, or publicly display any Service content
  • Modify, create derivative works from, or reverse engineer the Service
  • Use any automated means (bots, scrapers, etc.) to access or extract data from the Service
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Share, sell, or redistribute assessment questions, answers, or report content

9. User Content

9.1 Your Data

You retain ownership of any personal data you provide to IQTest360. By using the Service, you grant us a limited license to use, process, and store your data as necessary to provide and improve the Service, as described in our Privacy Policy.

9.2 Assessment Results

Your assessment results, including IQ scores, personality profiles, and training progress, are generated by our algorithms based on your responses. While you may view and download your own results, the underlying methodology and scoring algorithms remain our intellectual property.

9.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by IQTest360 without any obligation to compensate you.

10. Service Level Agreement

10.1 Availability

We strive to maintain 99.9% service uptime. However, we do not guarantee uninterrupted access and may experience downtime due to:

  • Scheduled maintenance (we aim to notify users in advance)
  • Emergency security patches or critical updates
  • Circumstances beyond our reasonable control (force majeure)

10.2 Performance

We are committed to providing a fast, reliable experience. Assessment pages are designed to load within reasonable timeframes, and we continuously monitor and optimize performance.

11. Technical Requirements

11.1 Supported Platforms

IQTest360 is a web-based service accessible via modern web browsers, including:

  • Google Chrome (latest 2 versions)
  • Mozilla Firefox (latest 2 versions)
  • Safari (latest 2 versions)
  • Microsoft Edge (latest 2 versions)

11.2 Requirements

  • A stable internet connection is required for all features
  • JavaScript must be enabled in your browser
  • Cookies must be enabled for authentication and session management
  • We recommend a screen resolution of at least 320px width for optimal mobile experience

12. Customer Support

12.1 Support Channels

We provide customer support through the following channels:

  • Billing issues: within 2 business days
  • Technical issues: within 2 business days
  • Account security concerns: within 1 business day

12.3 Support Availability

Our support team operates 24/7/365. While automated responses may be immediate, human responses follow the timeframes outlined above.

13. Limitation of Liability

13.1 Service Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2 Limitation

To the maximum extent permitted by applicable law:

  • IQTest360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to IQTest360 in the 12 months preceding the claim
  • We are not liable for decisions you make based on assessment results or recommendations

13.3 Exceptions

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute resolution, we encourage you to contact us at info@iqtest360.com to attempt to resolve the matter informally. Most concerns can be resolved quickly through direct communication.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts.

14.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Service Modifications

15.1 Changes to Service

We reserve the right to:

  • Add, modify, or remove features at any time
  • Update assessment content and methodologies
  • Change pricing for future billing periods (with notice)
  • Temporarily or permanently discontinue any part of the Service

15.2 Price Changes

If we change subscription pricing, we will provide at least 30 days' notice before the new price takes effect. You may cancel your subscription before the price change takes effect if you do not agree with the new pricing.

15.3 Notification

We will notify you of material changes to the Service or these Terms via the email address associated with your account.

16. Account Termination

16.1 Termination by You

You may terminate your account at any time by canceling your subscription through the cancellation page or by contacting us at info@iqtest360.com. Upon cancellation:

  • Your access continues until the end of your current billing period
  • No further charges will be applied
  • Your data will be retained in accordance with our Privacy Policy

16.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • Your payment method is declined and not updated within a reasonable timeframe
  • You use automated systems to access the Service

16.3 Effect of Termination

Upon termination:

  • Your access to premium features will be revoked
  • Any unused credits will be forfeited
  • Provisions that by their nature should survive termination (liability, IP rights, dispute resolution) will remain in effect

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and IQTest360 regarding your use of the Service.

17.2 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or the right to enforce it at a later time.

17.3 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
